AI Director Terms of Service

1. Service Description

AI Director is an artificial intelligence-powered video generation service provided by MATA AI. MATA AI is a trade name operated by Daniel Isaac Mata Padilla, an individual conducting business under Mexican law (RFC: MAPD861018N52).

The service allows users to create short-form videos (4, 8, or 12 seconds) using text prompts, reference images, and/or storyboard inputs. All videos are generated using advanced AI models and delivered digitally. Typical generation times range from 5-30 minutes depending on system load; specific delivery times are not guaranteed.

2. Understanding AI-Generated Results

Important: Before using AI Director, we strongly recommend reading our How to Use Guide to understand how to get the best results from the service.

Nature of AI Generation

AI Director uses advanced artificial intelligence to generate videos. Due to the nature of AI technology, results may vary and are not guaranteed to match exact expectations. Key points to understand:

• Iterative Process: Achieving optimal, market-ready results typically requires 1-3 iterations. This is standard practice in AI video generation.
• Variable Output: Each generation produces unique results. The same prompt may yield different outputs.
• Creative Interpretation: AI interprets prompts creatively; results may differ from your mental visualization.
• No Guaranteed Outcomes: We do not guarantee specific visual outcomes, styles, or exact adherence to prompts.

Setting Realistic Expectations

By using AI Director, you acknowledge that:

• AI-generated content is experimental and evolving technology
• Multiple generations may be necessary to achieve desired results
• Each video generation is a separate transaction
• Results that don't match personal expectations do not qualify for refunds (see Refund Policy)

3. Acceptance of Terms

By accessing or using AI Director, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

4. User Responsibilities

You agree to:

• Provide accurate information when creating video generation requests
• Not upload content that infringes on third-party intellectual property rights
• Not generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not use the service to create deepfakes or misleading content of real individuals without consent
• Not attempt to reverse engineer, decompile, or extract the AI models
• Comply with all applicable local, state, national, and international laws and regulations

5. Payment and Pricing

AI Director operates on a pay-per-video model. Pricing is displayed at the time of generation and varies based on:

• Video duration (4, 8, or 12 seconds)
• Resolution (720p or 1024p)

All payments are processed securely through Stripe. Payment is required before video generation begins. Prices are subject to change with notice.

6. Refund Policy

Due to the computational cost of AI video generation, all sales are final once the generation process has begun.

Refunds ARE Provided For:

• Technical failure preventing video delivery
• System error resulting in incorrect specifications (wrong duration, resolution)
• Service unavailability preventing generation
• Payment processed but no video generated

Refunds Are NOT Provided For:

• Results that don't match personal expectations or mental visualization
• Creative differences in AI interpretation of prompts
• Desire to try different prompts or settings
• Change of mind after purchase
• Results requiring iteration (as explained in Section 2)

By using AI Director, you acknowledge that you have read and understood Section 2 (Understanding AI-Generated Results) and accept that achieving optimal results may require multiple paid generations.

Refund requests must be submitted within 7 days of purchase to hi@mataai.studio.

7. Intellectual Property Rights

Your Content

You retain all rights to the prompts, images, and storyboards you provide as input to the service.

Generated Videos

Upon full payment, you receive a non-exclusive, worldwide, royalty-free license to use the generated videos for commercial and non-commercial purposes. MATA AI retains the right to showcase generated videos (with anonymization when appropriate) for marketing and promotional purposes.

Service Technology

All AI models, algorithms, and underlying technology remain the exclusive property of MATA AI and its licensors.

8. Content Moderation

MATA AI reserves the right to review, refuse, or remove any content that violates these terms. Prohibited content includes:

• Illegal or harmful content
• Content depicting violence, hate speech, or discrimination
• Sexually explicit or inappropriate content
• Content infringing on third-party rights
• Misleading or fraudulent content

9. Service Availability and Limitations

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Generation times may vary based on system load. MATA AI reserves the right to:

• Perform scheduled maintenance with advance notice
• Modify or discontinue features with notice
• Implement usage limits to ensure fair access
• Suspend accounts that violate these terms

10. Limitation of Liability

AI Director is provided "as is" without warranties of any kind. MATA AI shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from user-generated content
• Third-party claims related to generated content

Our total liability shall not exceed the amount paid for the specific video generation in question.

11. Data Usage and AI Training

MATA AI may use aggregated, anonymized data from service usage to improve AI models and service quality. We do not use your specific content inputs for training without explicit consent. See our Privacy Policy for details.

12. Changes to Terms

MATA AI may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or service notification.

13. Governing Law

These terms are governed by the laws of Mexico. Any disputes shall be resolved in the courts of Mexico City, Mexico.

14. Indemnification

You agree to indemnify, defend, and hold harmless MATA AI, its owner, affiliates, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from:

• Your use of AI Director or generated content
• Your violation of these Terms of Service
• Your infringement of any third-party rights
• Any content you submit to the service
• Any misuse or unauthorized distribution of generated videos

15. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and MATA AI regarding use of AI Director, superseding any prior agreements, communications, or understandings, whether written or oral.

16. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
